This privacy policy (the “**Policy**”) describes how Swissroc Asset Management collects, uses and protects the personal data of users of the website www.kingcross.ch (the “**Site**”).
1. Data controller
The controller responsible for the processing of personal data collected via the Site is:

2. Data collected
Depending on how the user uses the Site, the following categories of data may be collected:
**a) Data submitted via the contact form**
First and last name, company, email address, phone number and the content of the message, as well as any other information the user chooses to provide (for example, the type of space sought – office or retail).
**b) Browsing data and cookies**
IP address (truncated), browser and device type, operating system, pages viewed, time spent on the Site, date and time of visit, traffic source (referring site, keywords, campaign), and other data automatically collected for audience measurement and statistical purposes, in particular via Google Tag Manager and **Google Analytics** (see Section 8).
**c) Downloaded documents**
Where applicable, information relating to the viewing or downloading of the project brochure or other documents.
The Site does not collect any “sensitive” data within the meaning of applicable data protection law (health data, political or religious opinions, etc.).
3. Purposes of processing
Personal data collected is processed for the following purposes:
– responding to information and contact requests concerning the KingCross project and its available spaces;
– ensuring commercial follow-up with the leasing partners in charge of letting the spaces (in particular JLL);
– compiling audience statistics and improving the content and functioning of the Site;
– ensuring the security of the Site and preventing fraud;
– complying with any applicable legal or regulatory obligations.
4. Legal basis for processing
The processing activities described above are based, as applicable, on:
– the controller’s legitimate interest in promoting the KingCross project and responding to requests from interested users;
– the user’s consent, in particular with respect to non-essential cookies;
– the performance of pre-contractual steps taken at the user’s request (for example, in the case of a leasing enquiry).
5. Recipients of data
Personal data may be disclosed to:
– authorized employees of Swissroc Asset Management;
– the project’s leasing partners, in particular JLL, for the purpose of processing requests relating to the leasing of the spaces;
– technical service providers acting on behalf of Swissroc Asset Management (Site hosting, maintenance, audience measurement tools such as Google Tag Manager and Google Analytics, operated by Google Ireland Limited and/or Google LLC), acting as processors and bound by confidentiality and security obligations;
– competent authorities, where required by law.
This data is neither sold, rented nor transferred for commercial purposes to third parties other than those mentioned in this Policy.
6. International data transfers
Certain technical service providers (in particular Google, in connection with Google Tag Manager and **Google Analytics**) may be established or process data outside Switzerland, including in the United States, a country that has not been recognized as ensuring an adequate level of data protection. In such cases, Swissroc Asset Management ensures that appropriate safeguards are put in place (in particular Google’s standard contractual clauses and the additional measures provided by Google in connection with its services) to guarantee an adequate level of protection for the transferred data.
7. Retention period
Personal data is retained for as long as necessary to fulfil the purposes described in Section 3, and in particular:
– data submitted via the contact form is retained for the time necessary to process the request, and thereafter archived for a reasonable period for evidentiary purposes, unless a longer retention period is required by law;
– browsing data and cookies are retained for a maximum of 13 months, in accordance with standard audience measurement practices.
8. Cookies and audience measurement tools
The Site uses **Google Tag Manager**, a tool used to manage the deployment of third-party tags and scripts, as well as **Google Analytics**, a statistical audience measurement service provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) and/or Google LLC (United States).
Google Analytics places cookies or similar technologies on the user’s device in order to generate statistics on the use of the Site: pages viewed, duration of visits, bounce rate, traffic source, device and browser type, approximate geographic area, etc. This data is transmitted to Google, which processes it on behalf of Swissroc Asset Management, in particular on servers located outside Switzerland (see Section 6).
These cookies are only placed with the user’s prior consent, obtained through the cookie banner or the preference management tool made available on the Site. Users may withdraw their consent or change their preferences at any time via this tool, or by configuring their browser to reject cookies. Refusing non-essential cookies does not prevent access to the Site but may affect the availability of certain features and will prevent data collection by Google Analytics.
Users may also opt out of tracking by Google Analytics by installing the opt-out browser add-on made available by Google, available at: https://tools.google.com/dlpage/gaoptout.

9. Data security
Swissroc Asset Management implements appropriate technical and organizational measures to protect personal data against unauthorized access, loss, alteration or disclosure.
10. Rights of data subjects
In accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the General Data Protection Regulation (GDPR) for users located in the European Economic Area, every individual has the following rights with respect to their personal data:
– right of access;
– right to rectification;
– right to erasure, within the limits provided by law;
– right to object to processing;
– right to restriction of processing;
– right to data portability, where applicable.

A response will be provided as soon as reasonably possible. In the event of a persistent disagreement, data subjects have the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC), or, for residents of the European Economic Area, with the competent supervisory authority of their country of residence.
11. Minors
The Site is not intended for minors, and does not knowingly collect personal data relating to them.
12. Amendments to this Policy
Swissroc Asset Management reserves the right to amend this Policy at any time, in particular to comply with any legal, regulatory or technical developments. The version applicable is the one published on the Site on the date of consultation.
