1. Purpose
These terms of use (the “**Terms**”) govern access to and use of the website www.kingcross.ch (the “**Site**”), dedicated to presenting the KingCross real estate project located at Rue Peillonnex 39, 1225 Chêne-Bourg (Geneva, Switzerland).
By accessing and browsing the Site, users acknowledge that they have read and unconditionally accept these Terms. Users who do not accept these Terms are invited not to use the Site.

3. Design and hosting
The graphic and technical design of the Site was produced by the agency Base Design. Hosting is provided by a third-party technical provider ensuring the availability and security of the Site. The host’s contact details may be obtained upon request from the publisher, using the contact details set out in Section 2.
4. Access to the Site
The Site is accessible free of charge, from any location, to any user with internet access. All costs required to access the Site (computer equipment, internet connection, etc.) are the sole responsibility of the user.
The publisher uses reasonable efforts to ensure quality access to the Site but is under no obligation to achieve this. The publisher may, at any time, suspend, restrict or interrupt access to the Site, in particular for maintenance purposes, without incurring any liability and without prior notice.
5. Nature of the information published
The Site is exclusively informational and promotional in nature and relates to the KingCross real estate project. Information, visuals, plans, computer-generated images, indicative surface areas, delivery dates, virtual tours and other content presented on the Site are provided for indicative purposes only and do not constitute a contractual commitment.
Such content may be modified at any time, in particular depending on the progress of the project, without prior notice or any obligation of immediate update. It does not constitute a firm offer, contractual commitment or guarantee of any kind on the part of the publisher, its partners or the project stakeholders. Only signed contractual documents (leases, reservation agreements, etc.) are binding.
6. Intellectual property
All elements comprising the Site (texts, images, photographs, illustrations, logos, trademarks, plans, videos, virtual tours, graphic charters, Site structure, etc.) are protected by copyright, trademark law and, more generally, by any applicable intellectual property right, and are the exclusive property of Swissroc Asset Management or its partners and licensors (in particular the agency Base Design, JLL, and the project’s visual content providers).
Any reproduction, representation, modification, publication, transmission or alteration, in whole or in part, of the Site or its content, by any means and on any medium whatsoever, is prohibited without the prior written authorization of the publisher, subject to statutory exceptions.
7. Hyperlinks
The Site may contain hyperlinks to third-party websites (in particular to leasing partners, third-party-hosted virtual tour tools, or social media). The publisher exercises no control over such third-party sites and disclaims any liability for their content, availability or privacy practices. Access to such sites is at the user’s own risk.
8. Contact form
The Site enables users to contact the publisher or its leasing partners via a contact form or the contact details published on the Site. Users undertake to provide accurate, complete and up-to-date information. The processing of data submitted through this form is described in the [Privacy Policy](/en/privacy-policy/).
9. Liability
The publisher endeavours to ensure the accuracy and timeliness of the information published on the Site, without being able to guarantee its completeness, accuracy or up-to-date nature at all times.

11. Governing law and jurisdiction
These Terms are governed by Swiss law, to the exclusion of conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.
Any dispute relating to the interpretation or performance of these Terms shall be subject to the exclusive jurisdiction of the courts of the Canton of Geneva, subject to any mandatory legal provisions to the contrary.
12. Amendments to these Terms
The publisher reserves the right to amend these Terms at any time. The version applicable is the one published on the Site on the date of consultation by the user.
